Please review the terms that govern your access to and use of FreedomPath.
IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONTAIN IMPORTANT PROVISIONS CONCERNING ARBITRATION, CLASS ACTIONS, LIMITATIONS OF LIABILITY, INDEMNIFICATION, GOVERNING LAW, JURISDICTION, AND YOUR USE OF THE SERVICES. BY ACCESSING OR USING THE SITE OR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
Introduction and Acceptance
This website, membership platform, applications, software, tools, products, services, communications, and related offerings (collectively, the "Site" or "Services") are operated by Freedom Financial Plus LLC d/b/a FreedomPath, an Alabama limited liability company ("FreedomPath," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Services and constitute a legally binding agreement between you and FreedomPath.
By accessing, browsing, registering for an account, purchasing a product or service, submitting information, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not access or use the Services.
You acknowledge that your use of the Services, access to information and materials, and opportunity to receive the benefits made available through the Services constitute sufficient consideration for these Terms.
1. Definitions
"Content" means all text, software, code, scripts, graphics, photographs, video, audio, data, information, designs, interfaces, documents, materials, features, functionality, trademarks, service marks, logos, and other materials made available through the Services.
"User," "you," and "your" mean any person or entity accessing or using the Services.
"Submission" means any text, message, idea, suggestion, photograph, video, audiovisual work, name, likeness, voice, profile, communication, review, feedback, or other material submitted, posted, uploaded, transmitted, or otherwise provided through the Services.
"Third-Party Services" means websites, applications, payment processors, vendors, software, products, services, or other offerings operated or provided by parties other than FreedomPath.
2. Additional Terms
Certain products, subscriptions, programs, promotions, contests, sweepstakes, financing-related services, broker or membership programs, applications, or other offerings may be subject to additional terms, disclosures, agreements, compensation plans, policies, or service-specific rules. Those terms are incorporated into these Terms by reference. If there is a conflict, the service-specific terms control solely with respect to that service.
3. Modifications to These Terms and Services
We may modify, supplement, replace, or update these Terms at any time in our discretion. Updated Terms become effective when posted unless a later effective date is stated. Your continued access or use of the Services after changes become effective constitutes acceptance of the revised Terms.
We may also modify, suspend, restrict, replace, discontinue, or remove any portion of the Services, Content, products, features, functionality, or availability at any time, with or without notice, and without liability, subject to any rights that cannot lawfully be waived.
You are responsible for reviewing the current Terms periodically. The Last Modified date identifies the most recent revision.
4. Eligibility and Conditions of Use
You must comply with all applicable laws and these Terms. You represent and warrant that information you provide is accurate, current, and complete.
No person under eighteen (18) may enroll as a FreedomPath Independent Broker or register as a member. Children under thirteen (13) may not purchase products through our websites. We do not knowingly solicit or collect personal information from children under thirteen.
You may not use the Services if doing so would violate applicable law, regulation, court order, contractual obligation, or third-party rights.
5. Prohibited Conduct
You agree not to, directly or indirectly:
- Use the Services for unlawful, fraudulent, deceptive, abusive, harassing, threatening, defamatory, or otherwise harmful purposes.
- Reverse engineer, decompile, disassemble, translate, copy, reproduce, modify, adapt, create derivative works from, or attempt to discover source code or non-public functionality.
- Use bots, crawlers, scrapers, spiders, data-mining tools, automated scripts, or other automated or manual processes to harvest information or interfere with the Services.
- Attempt to access accounts, systems, networks, data, or secured portions of the Services without authorization.
- Interfere with or disrupt the integrity, security, performance, or operation of the Services.
- Transmit malware, viruses, harmful code, or other destructive material.
- Impersonate another person or entity or misrepresent your identity, affiliation, authority, or relationship with FreedomPath.
- Use the Services to solicit users, collect personal information about other users, send spam, or conduct unauthorized advertising.
- Use the Services, Content, data, or information to develop, market, operate, or support a competing product or service.
- Sell, sublicense, lease, assign, share, transfer, or otherwise provide your account or access credentials to another person without our written consent.
- Remove, obscure, or alter proprietary notices, copyrights, trademarks, or other rights notices.
- Use the Services in a manner that could damage FreedomPath's reputation, goodwill, systems, relationships, or legal interests.
6. Products and Services
We endeavor to describe products and services accurately, but descriptions, specifications, images, availability, pricing, features, and other information may contain errors or omissions and may change at any time. FreedomPath does not warrant that descriptions or other Content are complete, accurate, current, or error-free.
We reserve the right to refuse, limit, cancel, or condition any order or service, including by person, account, geographic region, jurisdiction, quantity, or other criteria. We may discontinue any product or service at any time.
Taxes, delivery charges, processing charges, and other applicable fees may be added where required or disclosed at checkout.
7. Subscriptions, Renewals, Billing, and Cancellation
Subscription services renew automatically for successive subscription periods unless canceled before renewal in accordance with the applicable cancellation procedure. By subscribing, you authorize FreedomPath and its payment processors to charge your selected payment method for recurring fees, applicable taxes, and other authorized charges.
You remain responsible for subscription charges until cancellation or termination becomes effective. Failure to use a subscription does not, by itself, cancel the subscription.
We may retry declined payments, update payment information through payment-provider account updater services where available, and suspend or terminate access for unpaid balances. You remain responsible for amounts incurred before cancellation or termination.
We may change subscription pricing or material subscription terms with the notice required by applicable law. Continued use or renewal after an effective change constitutes acceptance.
You may cancel by emailing support@freedompath.com or using an available cancellation function in your member portal. Cancellation does not retroactively reverse charges already incurred.
You authorize us to use third-party payment processors and agree that their terms and privacy practices may also apply to payment processing.
8. Refunds and Chargebacks
Except where required by applicable law or expressly stated in writing for a particular purchase, all sales of FreedomPath products and services are final and non-refundable.
You agree not to initiate an improper chargeback or payment dispute for a transaction that you authorized or for which you received the purchased product or service. If you believe a charge is incorrect, you agree to contact us first so we may investigate and attempt to resolve the issue.
Nothing in this section limits rights that cannot lawfully be waived.
9. Intellectual Property
The Services and all Content are owned by FreedomPath or its licensors and are protected by copyright, trademark, trade secret, patent, and other intellectual-property laws. Except for the limited access rights expressly granted in these Terms, no ownership interest or license is transferred to you.
You may not copy, reproduce, republish, upload, post, transmit, distribute, sell, license, modify, publicly display, create derivative works from, or otherwise exploit Content without prior written authorization.
We reserve all rights not expressly granted. Any unauthorized use may cause irreparable harm for which monetary damages may be inadequate.
10. Trademarks
FreedomPath names, logos, trade dress, service marks, trademarks, slogans, and related branding, and those of our licensors, are protected intellectual property. Nothing in the Services grants you a license to use them. You may not use any mark in a manner likely to cause confusion, imply endorsement, create an unauthorized affiliation, or disparage FreedomPath or its licensors.
11. Limited License to Use the Services
Subject to these Terms, FreedomPath grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Services solely for their intended purposes. This license automatically terminates when your access is terminated or these Terms end.
You may not use the Services or Content for unauthorized commercial purposes, competitive intelligence, resale, redistribution, training of competing systems, or other purposes not expressly permitted by FreedomPath in writing.
12. Third-Party Websites, Products, and Services
The Services may contain links to or integrations with Third-Party Services. We do not control, operate, endorse, guarantee, or assume responsibility for Third-Party Services, their content, availability, security, policies, products, or practices.
Your use of Third-Party Services is at your own risk and may be subject to separate terms and privacy policies. FreedomPath is not responsible for losses arising from your dealings with third parties.
13. Copyright and Intellectual Property Complaints
FreedomPath respects intellectual-property rights. Notices of alleged copyright infringement should be submitted in writing and include the information required by applicable law. Our copyright agent may be contacted at bbrowning@maynardnexsen.com.
We reserve the right to remove or disable access to allegedly infringing material and to terminate repeat infringers where appropriate.
14. User Submissions
You retain any ownership rights you may have in your Submissions. By submitting material through the Services, however, you grant FreedomPath and its affiliates a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable, non-exclusive license to host, store, reproduce, modify, adapt, publish, translate, distribute, display, perform, create derivative works from, and otherwise use the Submission, including associated names, usernames, likenesses, voices, and biographical information, in any media and for commercial or non-commercial purposes.
You represent and warrant that you own or control all rights necessary to submit the material and grant this license, and that the Submission does not violate law, third-party rights, confidentiality obligations, or these Terms.
You acknowledge that submissions may be edited, reformatted, excerpted, or removed in our discretion. We are not obligated to pay you or obtain additional permission for permitted uses.
15. Accounts and Account Security
You are responsible for maintaining accurate account information and for all activity occurring under your account, whether authorized by you or not, except to the extent caused by FreedomPath's own legally actionable conduct.
You must maintain the confidentiality of usernames, passwords, authentication codes, and other credentials and must promptly notify us of suspected unauthorized access or security incidents.
We may require identity, eligibility, security, or verification information and may suspend access while verification or an investigation is pending.
16. Public Forums and Communications
Public forums, chats, message boards, profile areas, and similar features are not private communications. You should not disclose information through a public forum that you do not want others to see.
We do not undertake a duty to monitor every communication. We may, but are not obligated to, review, preserve, remove, restrict, or disclose communications where we believe it is appropriate or required by law.
17. Rules of Conduct
You may not submit content that is unlawful, defamatory, abusive, threatening, harassing, hateful, discriminatory, obscene, pornographic, fraudulent, deceptive, invasive of privacy, infringing, confidential without authorization, malicious, or otherwise harmful.
You may not upload content containing malware or material designed to impair the Services. You may not use forums for unauthorized solicitation, spam, fundraising, advertising, or promotion.
FreedomPath may remove or restrict content at any time, with or without notice, and without assuming a duty to monitor user activity.
18. Enforcement and Removal of Content
We reserve the right, but not the obligation, to investigate suspected violations, preserve evidence, remove or restrict Content, suspend or terminate accounts, refuse service, block access, cooperate with law enforcement, and disclose information where reasonably necessary to protect FreedomPath, users, third parties, or property or to comply with law, subpoena, court order, or governmental request.
19. U.S. Use; Geographic Restrictions
The Services are intended primarily for use in the United States. We do not represent that the Services are lawful, appropriate, or available in every jurisdiction. Users accessing the Services from outside the United States do so at their own initiative and are responsible for compliance with applicable laws.
We may restrict or refuse access to persons or jurisdictions where providing Services would violate applicable law or expose FreedomPath to unreasonable legal or regulatory risk.
20. Privacy and Data Practices
Our Privacy Policy governs the collection, use, disclosure, retention, and protection of personal information and is incorporated into these Terms by reference.
You authorize FreedomPath to process information as reasonably necessary to provide, maintain, secure, improve, administer, and support the Services, subject to the Privacy Policy and applicable law.
21. Communications, Electronic Records, and Consent
You consent to receive electronic communications from FreedomPath concerning your account, transactions, Services, support requests, policies, security, and other matters. You agree that electronic notices, disclosures, agreements, records, and signatures may satisfy legal writing requirements to the extent permitted by law.
You are responsible for maintaining a current email address and other contact information. We are not responsible for communications that cannot be delivered because your information is inaccurate, inaccessible, blocked, or outdated.
22. SMS and Text Messaging
If you consent to receive text messages from FreedomPath, you may receive promotional marketing and support-related messages. Reply STOP to opt out and HELP for support. Message and data rates may apply, and message frequency may vary. Consent to marketing messages is not a condition of purchasing goods or services where prohibited by law.

23. General Maintenance, Security, and Service Availability
The Services may be unavailable from time to time due to maintenance, upgrades, outages, security incidents, telecommunications failures, third-party failures, or circumstances beyond our reasonable control. We do not guarantee uninterrupted, timely, secure, or error-free availability.
You acknowledge that no internet-based system can be guaranteed completely secure. You use the Services at your own risk.
24. No Professional, Financial, Legal, Tax, Credit, or Investment Advice
Unless expressly stated in a separate written agreement, information provided through the Services is for general informational and educational purposes only and does not constitute legal, tax, accounting, financial, investment, lending, credit-repair, insurance, or other professional advice.
You are solely responsible for evaluating information and obtaining advice from appropriately licensed professionals where appropriate. FreedomPath does not guarantee any particular financial, credit, business, funding, insurance, investment, or other outcome.
25. Results, Earnings, and Performance Disclosures
Any examples, testimonials, projections, illustrations, case studies, performance information, income examples, business results, credit-score changes, funding outcomes, or success stories are illustrative only unless expressly stated otherwise. Individual results vary and depend on numerous factors.
Past performance or results do not guarantee future results. FreedomPath makes no representation or guarantee that you will achieve any particular financial, business, credit, funding, sales, income, or other result.
Where a product or service involves a third-party provider, lender, creditor, insurer, financial institution, credit bureau, or other independent party, FreedomPath does not control that party's approval, denial, underwriting, pricing, reporting, timing, or other decision.
26. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, CONTENT, PRODUCTS, SOFTWARE, INFORMATION, AND ALL RELATED OFFERINGS ARE PROVIDED 'AS IS,' 'AS AVAILABLE,' AND 'WHERE IS,' WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEDOMPATH DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPLETE, ACCURATE, CURRENT, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.
27. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEDOMPATH AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, OWNERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, PAYMENT PROCESSORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COST OF SUBSTITUTE SERVICES, OR OTHER COMMERCIAL LOSS, ARISING FROM OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF FREEDOMPATH AND THE OTHER PROTECTED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO FREEDOMPATH FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Where a limitation is prohibited, it shall apply to the maximum extent permitted by law.
28. Release
To the maximum extent permitted by law, you release FreedomPath and the protected parties identified above from claims arising from third-party conduct, third-party services, other users' conduct, or circumstances beyond FreedomPath's reasonable control. This release does not apply to liability that cannot lawfully be released.
You expressly waive, to the extent permitted by law, unknown claims arising from matters covered by this release, including any comparable statutory protection to the extent legally waivable.
29. Indemnification
You agree to defend, indemnify, and hold harmless FreedomPath and its parents, subsidiaries, affiliates, owners, officers, directors, members, managers, employees, agents, contractors, licensors, service providers, and representatives from and against any and all claims, demands, actions, proceedings, damages, judgments, liabilities, losses, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) your use or misuse of the Services; (b) your breach or alleged breach of these Terms; (c) your Submissions; (d) your violation of law or third-party rights; (e) fraud, negligence, willful misconduct, or unauthorized conduct by you; or (f) your relationship or dealings with another user or third party.
FreedomPath may assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate fully. You may not settle an indemnified claim in a manner imposing liability, admission, restriction, or obligation on FreedomPath without our prior written consent.
30. Termination and Suspension
We may suspend, restrict, or terminate your account, access to the Services, subscriptions, or these Terms at any time, with or without notice, where permitted by law, including for violation of these Terms, suspected fraud, security concerns, nonpayment, legal or regulatory risk, or conduct harmful to FreedomPath or others.
Upon termination, your right to use the Services immediately ends. Termination does not eliminate obligations or liabilities that accrued before termination. Sections concerning intellectual property, payments, disclaimers, limitations of liability, indemnification, dispute resolution, governing law, confidentiality, and any provisions that by their nature should survive shall survive.
31. Governing Law, Exclusive Jurisdiction, and Venue
These Terms and any dispute arising out of or relating to them, the Services, or the relationship between you and FreedomPath shall be governed by the laws of the State of Alabama, without regard to conflict-of-law principles, except to the extent federal law controls.
To the maximum extent permitted by law, any judicial action permitted under these Terms, including an action to compel arbitration, confirm, modify, vacate, or enforce an arbitration award, or seek permitted injunctive or equitable relief, shall be brought exclusively in the state courts located in Montgomery County, Alabama, or the United States District Court having jurisdiction over Montgomery County, Alabama.
You expressly consent to the personal jurisdiction and exclusive venue of those courts and waive objections based on lack of personal jurisdiction, improper venue, or forum non conveniens, to the extent permitted by law.
32. Arbitration Agreement and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO SUE IN COURT AND YOUR RIGHT TO A JURY TRIAL.
Except for the limited exceptions below, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, any purchase, subscription, communication, transaction, or your relationship with FreedomPath, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, shall be resolved exclusively through final and binding arbitration.
This agreement applies to users, visitors, customers, account holders, businesses, organizations, and other persons or entities using or accessing the Services, to the extent legally enforceable.
The arbitration agreement includes claims arising before or after acceptance of these Terms and claims involving FreedomPath's affiliates, subsidiaries, parents, officers, directors, members, managers, employees, contractors, agents, licensors, and service providers where they are entitled to invoke the agreement.
The arbitrator shall determine disputes concerning the interpretation, applicability, enforceability, or formation of the arbitration agreement, except where applicable law reserves a particular issue for a court.
Before arbitration, the claimant must provide written notice describing the dispute and requested relief. The parties shall attempt in good faith to resolve the matter for thirty (30) days after receipt of notice.
Arbitration shall be administered by the American Arbitration Association under its applicable Consumer or Commercial Arbitration Rules, as appropriate, except as modified by these Terms. Arbitration may be conducted remotely, by telephone, video conference, written submissions, or in person.
YOU AND FREEDOMPATH WAIVE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY RIGHT TO A JURY TRIAL OR TO HAVE COVERED CLAIMS RESOLVED IN COURT.
YOU AND FREEDOMPATH AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, REPRESENTATIVE, PRIVATE ATTORNEY GENERAL, OR PARTICIPANT IN ANY CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing prevents either party from: (a) bringing an eligible individual claim in small claims court; (b) seeking temporary or preliminary injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property, confidential information, systems, or prevent unauthorized access; or (c) pursuing matters before governmental or regulatory agencies where permitted by law.
The arbitration agreement is governed by the Federal Arbitration Act and applicable federal arbitration law. To the extent state law applies, Alabama law governs. Any arbitration proceeding, enforcement of an arbitration award, or judicial proceeding permitted under this section shall be subject to the jurisdiction and venue of the state or federal courts located in or serving Montgomery County, Alabama. The parties consent to such jurisdiction and venue.
Unless prohibited by applicable law, a user may opt out of arbitration by sending written notice to FreedomPath within thirty (30) days after first accepting these Terms or first using the Services, whichever occurs first. The notice must identify the user, account email if applicable, and clearly state the desire to opt out.
If any portion of this arbitration agreement is unenforceable, it shall be severed to the extent permitted by law. If the class action waiver is held unenforceable as to a particular claim or remedy, the parties intend that the claim be litigated to the extent required by law and that the remainder of the arbitration agreement remain enforceable to the fullest extent permitted.
This arbitration agreement survives termination of these Terms or your relationship with FreedomPath.
33. Confidentiality and Protected Information
You may receive or access non-public information concerning FreedomPath, its affiliates, technology, operations, pricing, customers, vendors, business methods, systems, or other proprietary matters. You agree not to misuse, disclose, copy, or exploit such information except as authorized by FreedomPath or required by law.
This provision does not prohibit legally protected disclosures, reports to governmental authorities, or communications protected by applicable law.
34. Compliance With Laws and Regulatory Requirements
You are solely responsible for complying with all laws and regulations applicable to your use of the Services and your activities, including applicable advertising, communications, privacy, intellectual-property, consumer-protection, financial-services, insurance, credit, and licensing requirements.
Nothing in the Services or these Terms authorizes you to act as FreedomPath's agent, representative, lender, insurer, attorney, financial advisor, or other regulated professional unless a separate written agreement expressly provides such authority.
35. No Agency, Partnership, or Fiduciary Relationship
Your use of the Services does not create a partnership, joint venture, employment, franchise, agency, fiduciary, or other relationship between you and FreedomPath unless expressly established by a separate written agreement signed by an authorized representative.
You have no authority to bind FreedomPath, make representations on its behalf, enter agreements in its name, or incur obligations for FreedomPath.
36. Electronic Consent and Contract Formation
You agree that clicking an acceptance button, checking a box, creating an account, completing a purchase, submitting information, or otherwise using the Services may constitute an electronic signature and affirmative acceptance of these Terms to the extent permitted by law.
Electronic records of acceptance, account activity, communications, purchases, and transactions may be maintained by FreedomPath and may constitute evidence of your agreement and transactions.
37. Force Majeure
FreedomPath shall not be liable for delay, interruption, failure, or inability to perform caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, governmental action, labor disputes, utility failure, internet or telecommunications failure, cybersecurity events, third-party platform outages, payment-provider failures, or other similar events.
38. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
39. No Waiver
A failure or delay by FreedomPath to enforce any provision or exercise any right does not constitute a waiver. Any waiver must be express and in writing and applies only to the specific instance identified.
40. Assignment
You may not assign, transfer, delegate, or sublicense these Terms or any rights or obligations under them without FreedomPath's prior written consent. Any attempted assignment in violation of this provision is void.
FreedomPath may assign or transfer these Terms, in whole or in part, without your consent in connection with a merger, acquisition, corporate reorganization, sale of assets, financing, change of control, or transfer to an affiliate or successor.
41. No Third-Party Beneficiaries
Except for the protected parties expressly entitled to invoke applicable provisions, these Terms do not create rights in any third party. The arbitration, limitation of liability, indemnification, release, and related protections are intended to benefit FreedomPath's affiliates, officers, directors, members, managers, employees, agents, contractors, licensors, vendors, service providers, and other protected parties.
42. Entire Agreement
These Terms, together with the Privacy Policy and any service-specific terms, agreements, disclosures, policies, or documents expressly incorporated by reference, constitute the entire agreement between you and FreedomPath concerning the Services and supersede prior or contemporaneous understandings concerning the same subject matter, except for separate written agreements that expressly govern a particular relationship or service.
43. Statute of Limitations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUES, OR IT SHALL BE PERMANENTLY BARRED. IF APPLICABLE LAW PROHIBITS A ONE-YEAR LIMITATION FOR A PARTICULAR CLAIM, THE SHORTEST PERIOD PERMITTED BY LAW SHALL APPLY.
44. Export Controls and Sanctions
Software and technology made available through the Services may be subject to United States export-control and sanctions laws. You represent that you are not located in, controlled by, or a resident or national of a jurisdiction or person subject to applicable U.S. sanctions or export restrictions and will not use or transfer the Services in violation of applicable law.
45. California and Other State-Specific Rights
Certain states provide consumers with rights that cannot be waived by contract. Nothing in these Terms is intended to eliminate or restrict rights that applicable law prohibits us from limiting. Where a state-specific disclosure, right, or procedure is required, FreedomPath will provide it in accordance with applicable law and may maintain separate privacy or consumer disclosures for that jurisdiction.
46. California Privacy Requests
California residents may have privacy rights under applicable California law. Requests concerning personal information should be submitted through the contact method identified in the FreedomPath Privacy Policy or by contacting support@freedompath.com. Any request will be handled in accordance with applicable law and the Privacy Policy.

48. Effective Date
These Terms are effective as of September 3rd, 2026, and remain effective until modified or replaced in accordance with these Terms.
